Terms & Conditions of Rental and Booking

(English translation – for information purposes only)

Important: This translation of the Terms & Conditions is provided for information purposes only. In the event of a dispute or difference of interpretation, only the French version (“Conditions Générales de Vente”) shall be legally binding.

Article 1 – Contract

This seasonal rental contract is reserved for the exclusive use of accommodation at the Gîtes of Mas Lafarge located at 43 Place Lafarge, 07700 GRAS.
Under no circumstances can our liability be engaged in the event of use of this contract by third parties or for purposes other than tourism.

Article 2 – Duration of stay

The tenant signing this contract concluded for a specific period shall not, under any circumstances, claim any right to remain on the premises after the stay.

Article 3 – Formation of the contract

The booking becomes effective once the tenant has sent the owner a deposit of 50% of the total rental amount along with a signed copy of the rental contract.
The rental agreement concluded between the parties to this deed cannot, under any circumstances, benefit even partially to third parties, natural or legal persons, without the written consent of the owner.
Any violation of this last clause may result in the immediate termination of the rental to the tenant’s fault, with the rental proceeds remaining definitively acquired by the owner.

Article 4 – Completion of the booking file

The name, first name, age, and address of each person must appear in the booking file. For minors, they must be accompanied by their legal guardian, for obvious security reasons (weather alerts, hospitalization, severe bad weather, illness, etc.).

Accepted payment methods:

  • Bank cheque payable to Le Mas Lafarge (French bank accounts only),

  • Bank transfer,

  • Secure online payment via the website.

It is mandatory to mention the booking reference with your payment.

Article 5 – Rates

The rates shown on our gîte presentation sheets include all taxes, except tourist tax (and excluding excessive consumption).
Our prices are calculated based on the VAT rates in force and are subject to change in the event of modification of those rates.
If the balance is not paid before the day of arrival, we reserve the right to cancel your stay. A recovery fee of €40 will be charged.

Article 6 – Taxes and contributions

You will find the amount of the tourist tax and any other taxes related to your accommodation in the Rates section (available upon request).

Article 7 – Capacity

The number of people indicated per accommodation unit in our brochures and rates corresponds to the maximum authorized occupancy based on the available equipment.
It cannot be exceeded for reasons of safety and insurance.
We reserve the right to refuse access to the accommodation if the number of people exceeds the maximum authorized capacity.

Article 8 – Declaration of any private events (birthday or other private events)

It is mandatory to declare any private event (birthday or other) before your arrival, indicating the number of people present and respecting the safety and tranquility rules of the premises (lowering the music volume as of midnight).
You must also declare the event to your own insurance, without fail.

Article 9 – Modification of stay

Any modification of the stay regarding dates, location, duration, number of people, or family composition must be validated by our services.
It may, if necessary, result in additional charges.
In case of external events beyond our control, we may modify or cancel your stay.
We will then offer you, subject to availability, an equivalent stay with different dates or accommodation.
If this proposal does not satisfy you, all amounts paid will be refunded. No other compensation may be claimed.

Article 10 – Absence of withdrawal right

For bookings made by mail, telephone, or internet, the tenant does not benefit from a withdrawal period, in accordance with article L121-21-8 of the French Consumer Code, which concerns accommodation services provided on a specific date or for a specific period.

Article 11 – Cancellation by the tenant

a) Cancellation before arrival:
The deposit and administrative fees remain acquired by the owner for any stay canceled more than 30 days before arrival.
For any stay canceled within the 30 days preceding the arrival date, interrupted or not consumed for any reason whatsoever, the total amount of the reserved stay will be due or will remain acquired by Mas Lafarge.
No refund is planned in case of interruption of the stay. Moreover, if the stay is shortened, the rental price remains due to the owner.
If the tenant does not show up within 24 hours following the arrival date indicated in the contract, the contract becomes null and void, and the owner may dispose of the gîte.
The deposit also remains acquired by the owner, who will request payment of the rental balance.

Article 12 – Cancellation by the owner

The owner will refund the tenant the full amounts paid.

Article 13 – Arrival

The tenant must arrive on the date and at the time mentioned in the contract.
In case of late or delayed arrival, the tenant must inform the owner.

Article 14 – Payment of the balance

The balance of the rental must be paid no later than 8 days before entering the premises.

Article 15 – Inventory

An inventory is drawn up jointly and signed by the tenant and the owner or their representative upon arrival and departure from the gîte.
This inventory is the only reference in the event of a dispute concerning the condition of the premises.
The cleanliness of the gîte upon the tenant’s arrival must also be recorded in the inventory.
The cleaning of the premises during the rental period is the responsibility of the tenant.

Article 16 – Security deposit

Upon the tenant’s arrival, a security deposit of €600 must be provided either by cheque payable to Mas Lafarge or via online payment through the site.
After the jointly conducted check-out inventory, this deposit will be refunded — in the case of a cheque or within less than a week if the deposit was made online — less any restoration costs in case of damages or missing goods.
In the event of early departure (before the agreed time), preventing the establishment of the inventory at the time of departure, the security deposit will be returned by the owner within a maximum of one week.

Article 17 – Use of the premises

The tenant must ensure the peaceful nature of the rental and use it in accordance with the intended purpose of the premises.

Article 18 – Capacity

The present contract is established for a maximum capacity indicated in the rental agreement.
If the number of tenants exceeds the accommodation capacity, the owner can refuse the additional persons.
Any modification or breach of the contract will be considered as initiated by the client.

Article 19 – Pets

Pets are not allowed in the gîtes of Mas Lafarge except in specific cases with express authorization.
If this clause is not respected, the owner may refuse the stay, and no refund will be made.
In the exceptional case where a pet is allowed:

  • Pets may not roam freely and must be kept on a leash.

  • Pets are not permitted in common areas (swimming pools, laundry room, workshop, etc.).

Their stay is subject to two conditions:

  • Valid rabies vaccination,

  • Identification by tattoo or microchip, attested by a certificate issued by the Central Canine Society.

Article 20 – Insurance

The tenant is responsible for all damages caused by them.
They must be insured by a “holiday insurance” contract covering these various risks.

Article 21 – Valuables

It is recommended not to leave valuables in the accommodations.

Article 22 – Payment of charges

At the end of the stay, the tenant must pay the owner the charges not included in the price (applicable during the low season – meter reading for the winter periods from November to February inclusive).
The amount is calculated based on the real electricity cost per kWh, with the presentation of the electricity bill as proof.

Article 23 – Cleaning and selective sorting

Cleaning is the tenant’s responsibility throughout the stay.
Cleaning equipment is provided for this purpose.
Selective waste sorting is mandatory.
A compost bin is available in the courtyard.
Waste bins are located outside the village.

Article 24 – Claims and disputes

Any complaint regarding the inventory and description of the property must be submitted to both parties by registered mail within 15 days after the end of the stay at the following address:

In case of technical issues affecting leisure equipment (pool, etc.), Mas Lafarge shall not be held responsible, and no refund will be made.

In case of litigation, only the jurisdiction of the Tribunal of Colmar is recognized.

Article 25 – Image rights

You expressly and without compensation authorize Mas Lafarge to use photographs taken of you and your children during your stay for promotional purposes.

Article 26 – Wifi

Wifi is free and secured in certain areas of the property and in the gîtes.

Each user of the Wifi undertakes to respect IT and ethical standards, notably:

  • Not to access sites with racist, pedophile, hateful, or violent content,

  • Not to commit offences or acts of hacking violating the rights of others and the safety of individuals,

  • Not to intentionally perform operations that could alter or modify data, hide one’s real identity, or access unauthorized information from other users of the network,

  • Not to interrupt or disrupt the normal functioning of the network or connected systems,

  • Not to modify or destroy information on any system,

  • Not to connect or attempt to connect to a site without authorization.

Article 27 – Smoking

Smoking is prohibited inside the gîtes.
Due to the risk of fire, it is strongly recommended to exercise extreme caution when smoking outdoors.

Article 28 – Arrival / Departure

The preferred arrival time is between 4:00 p.m. and 8:00 p.m..
It is essential to inform us in advance at +33 6 23 85 30 94.

The gîtes must be vacated by 10:00 a.m. on the day of departure.
You are asked to leave the premises as clean as possible and to return any borrowed equipment to the designated area.
